Second Injury Fund

Work related injuries may result in a New Jersey worker being Totally Disabled even when that worker’s overall disability is only partially due to the work connected injury. A special provision in the New Jersey Workers Compensation Statute provides that if the last work injury, in conjunction with any prior disability, work related or not, renders a person 100 % Totally and Permanently Disabled, that person is entitled to full Total Disability benefits.
The law requires that the workplace injury must be the “final straw” which pushes the worker over the edge into Total Disability. In this situation a special fund (The Second Injury Fund) pays that portion of the disability which is due to the pre-existing injuries and conditions. The reasoning behind this provision is to aide in the hiring of disabled workers. Employers can be assured that in the event of an accident they will only pay benefits for the injury which occurs on their job. This provision does not apply if the worker becomes Totally Disabled due to a last non-work connected injury in conjunction with a previous work related injury.
