WHY IS IT THAT SO MANY PEOPLE DO NOT UNDERSTAND DISCRIMINATION

I get many phone calls from employees claiming that they have been the victim of discrimination from terminations, to pay raises, to being passed over for a promotion. When we begin to discuss the facts surrounding the employment setting it becomes clear to me that this potential client was not the victim of discrimination. It may have been office politics, favoritism, and yes even nepotism but it is not discrimination. Remember when we are claiming discrimination it must, must, must be based on one of the following: age, race, religion, national origin, disability, or gender. Almost anything else in the employment setting is fair game. What does that mean? It means you as the employee claiming discrimination must have some form of evidence that your employers actions were motivated by the 1 of the above protected classes. For example, if I can prove that i was fired because of my severe diabetic condition, no matter what the employers reason is i can bring a case for disability discrimination. However, if i am a severe diabetic and i am fired because i was rude to a customer, forget it i have no case. The key is the evidence you bring to the table. Just because you are in 1 of the protected classes named above and something adverse happens to you on your job does not mean the reason is because of the class your in. You must be aware of your surroundings and document, document, and document evidence of discrimination. Send E mails, certified letters and yes you may have to resort to tape recordings in order to gather your evidence. Comments like ” isn’t it time you retired” or ” 20 years ago we never had any women working here” may be evidence of discrimination. The problem is once you let the comment go, you have no proof it was ever said never mind that it was the reason for the adverse job action.
