What Happens with Health Benefits if I am out on Comp

A client told us he was injured at work and was receiving Workers’ Compensation. He said his regular health insurance and dental benefits were allowed to lapse since he was out. He felt his employer should be obligated to continue paying for these benefits since he was injured at work. I agree with him completely, but unfortunately, that is not the way it works. Even if an employee is out on Workers’ Compensation, his employer is under no obligation to pay his medical benefits. Quite frequently, employers stop benefits, and never even tell the injured employee. You should check with your employer to find out what their policy is. Fortuantely, many employers will continue regular benefits while on comp.

Keep in mind that an employer had to allow you to apply for COBRA benefits if you are separated from the company or the employer is no longer paying.

In addition, when a worker is out on compensation, an employer can invoke The Family Medical Leave Act. This means they have to protect the employee’s job only for 90 days. After that period of time, an employer can terminate the injured employee. Again, employers typically will not do this, but it is a concern.
