When should I seek Legal Representation After an Accident?

Many people ask themselves after they are injured in an accident, “when is the right time for me to seek legal advice?” The simple answer to this question is as soon as possible. As soon as you are physically capable after an accident you should contact an attorney to find out, not only what your rights are, but what you have to do to protect any potential recourse you may have.

Many people have heard the term Statute of Limitations, which means that there is a fixed number of years in which a lawsuit against a liable party must be commenced within. In New Jersey, this period of time is generally two years. However, waiting an extended period of time to contact an attorney after an accident could prove to be costly error. For example, if the negligent party in your action is a public entity or a public employee, there is a strict notice requirement that must be adhered to which is far shorter than the general Statute of Limitations. In certain circumstances it may be very difficult to realize that a public entity is involved (see our Fall on Sidewalk Blog from October 11, 2007), thus you should speak with an attorney as soon as possible in these situations.

In addition, soon after an accident you will likely be contacted by an insurance representative, be asked to testify in municipal court, or have some form of a statement requested under another setting. It is important to know that at any point after your accident, any statements that you make can only be used against you in any case that you may have in the future, not in you favor. Thus, it is important to contact an attorney as soon as possible after an accident to protect your rights.
