New Jersey’s Consumer Protection Law

Often described as one of the toughest laws of its type, our State’s consumer protection laws impose some stringent requirements on many merchants while providing for substantial remedies when there is a violation.  Known as the Consumer Fraud Act,
New Jersey law requires those in certain businesses, such as home improvement contracts, furniture sales and automobile repair, to follow some strict guidelines when dealing with consumers.  For example, most home improvement contracts must be in writing and must have any alterations to the original terms confirmed in writing.  Start and finish dates also have to be provided along with warranty information for items used in the home improvement.  Furniture sales contracts must provide specifics on delivery dates and remedies when those dates cannot be met.  Contracts for automobile repairs must have a signed authorization from the consumer or a written notation that telephone authorization was obtained which indicates the phone number at which the consumer was contacted.  Even a technical failure of the law’s requirements can subject a merchant to triple damages and require them to pay for the wronged consumer’s legal fees and expenses.  The law provides for these remedies so that the little guy can take on the defrauding merchant who oftentimes has greater resources.  The best thing you can do to avoid getting in such a situation is to deal with reputable merchants and make sure all of the terms you are concerned about are reduced to writing.  This way there can be no questions about what your expectations were at the time of contract should things go awry.
