Is Marriage an Insurance Defense?

The Insurance Industry is not your friend even when you are the one paying the Workers’ Compensation Insurance premium. Every employer in New Jersey is required to carry Workers’ Compensation insurance for the protection of all employees. But insurance companies may still disclaim even when the employer is the one making the claim.

In a recent case, a husband and wife, who were the only employees of a public relations firm, found that an insurance company will fight every step of the way even when there is no basis to disclaim. In this tragic case, the wife was struck and killed while crossing a street before a business lunch with her husband. Although all proofs offered during the trial made it abudantly clear that the accident occured during and in the course of employment, the Insurance Company chose to fight merely because the parties involved were husband and wife.They reasoned that a married couple could nto be working at lunch. In the end, the Insurance Company’s lawyers offered no evidence against the claim but still fought all the way New Jersey Appelate Division.

If the Insurance industry is willing to fight their own paying customer when it is clear they have no chance of winning, you can be sure they will make every effort to fight an employee who is not their customer. That’s why a good lawyer is always necessary when you’re injured at work.
