As opening day is knocking on our door, one may wonder are we safe in our local professional baseball stadiums?  The answer is no.  The NJ legislature passed a law in 2006 giving limited immunity to the owners of professional baseball clubs and stadiums in New Jersey from injuries occuring to spectators who are struck by baseballs or baseball bats anywhere on the premises during a professional baseball game.  The legislature reasoned that there is an assumption of risk while observing a professional baseball game.  The owners have a limited duty to the fans to post and maintain warning signs at the entrances and stadium facilities where tickets are sold that “A spectator of professional baseball assumes the risk of any injury to person or property resulting from any of the inherent dangers and risks of such activity and may not recover from an owner of a baseball team or an owner of a stadium where professional baseball is played for injury resulting from the inherent dangers and risks observing professional baseball, including being struck by a baseball or a baseball bat anywhere on the premises during a professional baseball game.”   However, the law does require that the owner provide protection for spectators in the most dangerous sections of the stands.   This limited duty may be satisfied by having a net behind home plate.
